Terms of Service

These Terms of Service ("Terms") govern your use of gauntlet.gallery (the "Site") and any purchase from Gauntlet Gallery ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms.
1. About Gauntlet Gallery
You must be at least 18 years old and able to form a binding contract to place an order. You represent that all information you provide is accurate and that your payment method is yours to use. We reserve the right to verify identity and refuse or cancel any order. All prices are listed in US dollars. We collect sales tax in states where we have nexus.
2. Our Products
Gauntlet Gallery sells authenticated contemporary art, signed collectibles, and memorabilia — including prints by Shepard Fairey, KAWS, Banksy, Death NYC, Mr. Brainwash, Warhol, Haring, Murakami, and D*Face; BE@RBRICK figures; signed music memorabilia; and space memorabilia. Each piece is sold with a Gauntlet Gallery COA and — where applicable — a third-party certificate from Beckett, JSA, PSA/DNA, or Zarelli Space. Where a blockchain certificate has been issued for a specific piece, it is provided with that order.
We accept major credit cards, PayPal, Apple Pay, Google Pay, Shop Pay, and — for orders over $5,000 — wire transfer by request. We reserve the right to correct pricing errors and cancel orders placed at mispriced amounts (refunded in full if already charged).
3. Authenticity Guarantee
We represent that, to the best of our knowledge and based on third-party authentication where obtained, every piece sold through Gauntlet Gallery is authentic. Each category is governed by a specific authentication chain (Death NYC artist-signed COA + gold seal; KAWS / BE@RBRICK OneCOA + NFC; Warhol via TrueCOA; signed music via Beckett, JSA, or PSA/DNA; space memorabilia same plus Zarelli). We do not represent any piece as Pest Control–authenticated.
4. COA Guarantee Program
See our COA Guarantee for the full lifetime authenticity guarantee, including our 100% refund + 10% premium remedy if a piece is ever proven inauthentic.
5. Risk of Loss & Title Transfer
Title to the piece transfers to you upon our receipt of full payment. Risk of loss transfers upon delivery of the piece to the carrier, but all shipments are fully insured by us until you (or an adult at your address) signs for delivery. International buyers are responsible for all duties, VAT, and customs fees. We cannot undervalue declarations. See our Shipping Policy for details.
Returns are governed by our Refund Policy: 14-day return window from delivery, no restocking fee, full refund to original payment method within 5–10 business days of our receipt.
6. Intellectual Property
All content on the Site — logos, photography, written copy, arrangement, and trade dress — is owned by or licensed to Gauntlet Gallery. Artwork images are displayed under fair use, dealer rights, or license from the artist or estate. You may not reproduce, scrape, or redistribute Site content without written permission.
Purchasing a piece grants you ownership of that physical piece only. No copyright, reproduction right, display license, or derivative-work right is transferred. The artist or their estate retains all copyright.
You agree not to:

Use the Site for any unlawful purpose

Attempt to probe, scan, or reverse-engineer the Site or its infrastructure

Use bots, scrapers, or automated systems to place orders or harvest data

Impersonate another person or misrepresent your identity

Submit forged provenance or counterfeit artwork for consignment or authentication
Violation may result in order cancellation, account termination, and referral to law enforcement.
7. Third-Party Services
The Site integrates with third parties — Shopify, Klaviyo, UPS, FedEx, TrueCOA, ScoreDetect, Polygon blockchain, Google Analytics, Meta, and Hotjar. Your use of those services is subject to their terms. We are not responsible for third-party outages, data loss, or policy changes affecting their services.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or any purchase will first be subject to good-faith negotiation for 30 days.
If not resolved, the dispute will be finally resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in New York, NY. Each party bears its own costs, except as JAMS rules permit. You waive any right to bring or participate in a class action. You may opt out of arbitration within 30 days of your first purchase by emailing hi@gauntlet.gallery with "ARBITRATION OPT-OUT" in the subject.
Claims involving authenticity under the COA Guarantee may alternatively be brought in any court of competent jurisdiction in Delaware at the buyer's election.
9. Limitation of Liability
The Site is provided "AS IS" and "AS AVAILABLE." Except for the authenticity guarantee expressly stated in our COA Guarantee, we make no other warranties, express or implied, including merchantability, fitness for a particular purpose, investment performance, or future resale value. Art is not a guaranteed investment.
To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or any purchase is limited to the purchase price you paid for the piece at issue, except where the COA Guarantee provides a greater remedy (100% refund + 10% premium for inauthenticity). We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profit, lost data, or loss of resale opportunity.
You agree to indemnify and hold Gauntlet Gallery harmless from any claim arising out of your breach of these Terms, your misuse of the Site, or your violation of any third-party right.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be posted with a new Effective date and, for registered accounts, emailed. Continued use after a change constitutes acceptance.
We may suspend or terminate your account or order at any time for violation of these Terms, fraud, or risk to our business. These Terms survive termination where their context requires (IP, liability, governing law). These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and COA Guarantee, constitute the entire agreement between you and Gauntlet Gallery and supersede any prior communications.
